Welcome to This Magic Moment. These Terms & Conditions ("Terms") govern your use of our website at thismagicmomentproposals.com and the services provided by This Magic Moment LLC ("This Magic Moment," "we," "us," or "our"). By accessing our website, booking a service, or communicating with us, you agree to these Terms. If you do not agree, please do not use our website or services.

  1. OUR SERVICES

This Magic Moment provides experiential event services in the Las Vegas area, including surprise proposal experiences, hotel room decoration, event photography and videography, flash mob performances, and related celebration services. Specific inclusions, timing, and requirements for each service are described at the time of booking.

  1. BOOKING AND PAYMENT

Booking. Bookings are made through our website and third-party booking platform. Your booking is confirmed only when you receive a confirmation from us or our booking platform.

Payment. Payment is processed through our booking and payment providers at the time of booking unless otherwise stated. You agree to provide accurate and complete payment information and authorize us to charge the applicable fees.

Pricing. All prices are stated at the time of booking. We reserve the right to correct pricing errors and to change our prices for future bookings.

  1. CANCELLATIONS, CHANGES, AND REFUNDS

Cancellation, rescheduling, and refund terms are provided at the time of booking and may vary by service. Because our services require advance coordination of vendors, performers, venues, and materials, some bookings may be non-refundable or subject to cancellation fees. Please review the specific terms presented during your booking. If you need to change or cancel a booking, contact us as soon as possible and we will do our best to accommodate you, subject to the applicable terms.

  1. YOUR RESPONSIBILITIES

To help us deliver your experience, you agree to:

  • Provide accurate and complete information at the time of booking, including dates, times, locations, and contact details
  • Obtain any permissions you are responsible for (for example, ensuring guests are willing participants)
  • Be checked in to your hotel (for room decoration services) and meet any timing or access requirements we provide
  • Communicate changes to us promptly
  • Treat our staff, vendors, and performers with respect

You are responsible for the accuracy of the information you provide. We are not liable for service failures caused by inaccurate or incomplete information, or by circumstances outside our control (see Section 6).

  1. THIRD-PARTY VENUES AND LOCATIONS

Many of our services take place at hotels, resorts, restaurants, public landmarks, and other third-party locations. We do not own or control these locations, and access to them is subject to their rules, availability, and discretion. We are not responsible for actions, restrictions, closures, or conditions imposed by any third-party venue, including changes to public attractions or performances (such as fountain shows or other displays) that are outside our control.

  1. CIRCUMSTANCES OUTSIDE OUR CONTROL

We are not responsible for failure or delay in performing our services due to circumstances beyond our reasonable control, including but not limited to weather, acts of nature, venue closures or restrictions, third-party vendor cancellations, traffic, public events, government action, health emergencies, or other unforeseen events. If such circumstances prevent us from delivering a service, we will work with you in good faith to reschedule or provide an appropriate remedy consistent with our booking terms.

  1. PHOTOGRAPHY AND VIDEO

For services that include photography or videography, delivery timeframes, the number of images, and format are described at the time of booking. Delivery times are estimates. We are not responsible for delays or quality issues caused by circumstances outside our control, including venue conditions, weather, or third-party equipment.

Unless otherwise agreed in writing, we may use photographs and video from events for our marketing and promotional purposes. If you prefer that we not use your images, please let us know in writing before your event.

  1. VENDOR RELATIONSHIPS

This Magic Moment works with independent vendors and performers. These vendors are independent contractors, not employees of This Magic Moment. Vendors who receive job opportunities and communications from us do so as part of an existing business relationship and may opt out of text communications at any time by replying STOP.

  1. TEXT MESSAGING

By providing your mobile number, you consent to receive text messages from us as described in our Privacy Policy. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for assistance. Please see the Text Messaging section of our Privacy Policy for full details.

  1. INTELLECTUAL PROPERTY

All content on our website — including text, graphics, logos, images, and video — is owned by or licensed to This Magic Moment and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use our content without our prior written permission.

  1. DISCLAIMER OF WARRANTIES

Our website and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, or secure.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, This Magic Moment and its owners, employees, and vendors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services. Our total liability for any claim arising out of or related to a booking will not exceed the amount you paid for that booking.

  1. INDEMNIFICATION

You agree to indemnify and hold harmless This Magic Moment Proposals LLC and its owners, employees, and vendors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your breach of these Terms, your misuse of our services, or your violation of any law or the rights of a third party.

  1. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our services will be resolved in the state or federal courts located in Clark County, Nevada, and you consent to the jurisdiction of those courts.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
